INTRODUCTION
 
(A) Claims have been lodged on behalf of the MEMBERS in respect of properties owned, inter alia, by the Conservation Corporation Limited in the KwaZulu Natal Province in terms of the Restitution of Land Rights Acts, 22 of 1994
 
(B) The Department of Land Affairs, representatives of the MEMBERS and the Conservation Corporation (Proprietary) Limited have conducted negotiations for a settlement of the claims referred to in paragraph A above, and are about to enter into an agreement for the settlement of those claims by way of the sale of such properties to the Department of Land Affairs and the registration of the transfer of the properties into the name of a trust, but with a lease of the properties back to The Conservation Corporation (Proprietary) Limited.
 
(C) The FOUNDER is desirous of making a donation inter vivos to the TRUSTEES and of creating the TRUST contemplated in paragraph B for the purposes and upon the terms and conditions more fully set out hereunder.
 
(D) The TRUSTEES have agreed to accept office as such and to administer the TRUST.
